Booking
By purchasing a product or service on www.dehavilland.ltd you enter into an agreement with us and will be subject to our terms and conditions. It is the responsibility of the Voucher holder to ensure that the activity is booked within season bearing in mind that this may end before the expiry date of the Voucher. Once You have booked Your activity, you are bound by the terms and conditions. You must book and take your experience before the expiry date of the voucher.
Availability
No guarantee can be made as to availability of the activity on any day. We advise that the Voucher holder books as soon as possible before the preferred date. Flying activities are only available at weekends. Activities normal operate from White Waltham only. Should an activity become unavailable we will endeavour to inform You of this as soon as possible and offer an exchange or a refund to the purchaser of the Voucher. This will be the limit of Our liability and We will not be liable for any other costs incurred by the Voucher holder such as travel or accommodation.
Pricing and Price Promise
Please note that the prices and offers advertised on the Website may be changed from time to time. In the event of an activity being issued or processed at an incorrect price, we will advise the Voucher holder and offer either a full refund or for them to pay/receive the balance in price to their account. If the purchaser of a Voucher finds the identical product on sale from another supplier at a lower price within seven days of the purchase date and the experience is conducted within a 25-mile radius of White Waltham Airfield (excluding sales, special offers, time and date bookings and other promotions), we will match the price advertised.
Discounts and Promotions
We reserve the right to limit the use of discount codes to certain activities, price ranges and times. Most discounts and promotion codes have limitations; We are not always able to display the full terms of such discounts on smaller advertisements. Some discount codes apply to the whole checkout basket total others are service specific. Only one promotional code may be used at any time. You will be advised in the basket page if Your discount code may be applied to Your purchase. Please contact Us if You have any questions in relation to discount codes. When a discount code has been used for the original purchase, the value of the credit will be based on the amount paid, not on the pre-discount value of the Voucher. Please note that all promotional codes are for new online orders only and cannot be used in conjunction with an exchange or existing Voucher.
Security of Payment
Our Vouchers are not covered by the Financial Services Compensation Scheme. In the unlikely event of The DeHavilland Flying Academy becoming insolvent, some or all the credit on the Vouchers and/or tokens may not be available to spend. However, if You made Your purchase using a Visa Credit or Debit card or a MasterCard Credit card, you may be able to make a claim under the protection offered by Visa or MasterCard; please read the terms and conditions of Your Visa Credit or Debit card or a MasterCard Credit card.
Restrictions
Flying activities have several restrictions or limitations which may include limits on height, weight, and age. Please check all the information provided to ensure that the activity is suitable for the recipient. If You or the participant have any questions, please check with us before booking Your activity. Participants are required to be medically fit and well and must be physically capable of entering and exiting the aircraft without significant assistance.
Experience Descriptions
Whilst every effort is made to provide accurate details of the activities available, the duration of such activities given on the website should be used as guidelines only. We cannot be held liable for delays or equipment breakdowns – these occur from time to time and are expected when operating vintage aircraft. These descriptions should therefore be taken as a guide only and do not form part of the contract.
Booking Life
Vouchers are usually valid for 12 months from the date of purchase (unless otherwise stated) and shall become invalid 12 months from the date of purchase.
Vouchers may be extended for a further 12 months on payment of an admin fee of £10 plus any increase that may have taken place for that activity since the original date of purchase under exceptional circumstances and upon request. Please note that some Vouchers cannot be extended; this will be stated on the Voucher. PLEASE NOTE: You must book and take your experience before the 12 months elapses from the date of purchase.
Cancellation
Waiting time may be necessary with all activities, especially as some are weather dependent. There is also the possibility of short notice cancellation due to reasons such as the weather, mechanical problems, staffing issues or other unforeseen circumstances beyond our control. If the activity is cancelled, the participant should re-book with us as soon as possible. We will not be liable for any costs such as travel, or accommodation incurred by the participant in such circumstances. Once booked, if You cancel without giving the required notice under the terms and conditions, your activity may be forfeited.
Refunds
Refunds can be requested within 14 days of purchase unless the activity has already been booked. Refunds after this period will be at Our sole discretion and will be subject to a £20 or 20% (whichever is greater) fee. Note that refunds can only be made to the purchaser. Refunds will not be made to a Voucher holder who is not the purchaser, or any third party. Should an activity or specific location become unavailable We reserve the right to provide an exchange or a full refund to the original purchaser, this will be the limit of Our liability and We will not be responsible for any costs incurred such as travel or accommodation.
Limitation of Our Liability
As clearly stated above, by purchasing and booking Your activity, you will be subject to the terms and conditions stated herein, including restrictions and cancellation. We are the sole provider of activities and experiences however we may rely on a third-party supplier for some services, suppliers of aircraft and providers of carriage by air used in the activities. We will ensure that only suitably qualified and experienced pilots are used in the delivery of our services. We are however not responsible and cannot be held liable for the safety standards or performance of individual pilots or third-party suppliers of equipment or aircraft. Any loss or damage suffered by You whilst participating in the activity for which the pilot and or operator is solely responsible.
Where services are supplied directly by The DeHavilland Flight academy (aircraft owned and operated or pilots and crew employed or contracted by The DeHavilland Flight Academy) we will ensure that all insurances, qualifications, aircraft safety standards and operating standards are maintained to the highest level.
Indemnity, Waivers and Cancellation Insurance
Activities may require the completion of an indemnity form before participation. You may also be required to sign a Waiver of Liability with the Supplier in relation to any risks of injury.
Safety and Insurance
By taking part in a vintage flying activity or pilot training in a vintage aircraft, you accept the existence of an element of personal risk. Personal insurance policies vary in their coverage and may exclude activity. It is advisable to check Your insurance company in advance.
The DeHavilland Flight Academy has its own liability insurance and a copy can be supplied upon request. Most activities will rely on participants following instructions to comply with health and safety, please follow these carefully. We reserve the right to withdraw or end an activity if participants are deemed to be a danger to themselves or others.
Personal Data
The Data Protection Act requires Us to inform You that We hold information You provide on systems. You acknowledge that You will be providing Us with Your personal information when making bookings for activities. We will not provide these details to any other organisation when You book your activity/activities with. We use the information primarily for the provision of providing You with activities for related purposes, including updating and keeping Our records up to date. Our use of that information is subject to Your instructions and the Data Protection Act. Please refer to our privacy policy. The DeHavilland Flight Academy is registered with the Information Commissioners Office and a copy of our certificate can be supplied upon request.
Children's Issues
The Web Site is not directed to children under thirteen (13) years of age, and children under such age must not use the web site or services offered on it to submit any individually identifiable information about themselves.

Complaints
The easiest way of resolving a complaint is to address them on the day with a member of the team. If Your complaint cannot be resolved on the day, please send details to us at Ops@DeHavilland.Ltd, including your Name, contact email address and telephone number, date of booking, date of the activity, who You spoke to on the day and the nature of your complaint. We will endeavour to respond to your complaint within 72 hours.
Applicable Law
These Terms shall be governed by and construed in accordance with English law. The Courts of England shall have exclusive jurisdiction in relation to any claim, dispute or difference concerning any matter arising from these Terms.
